HOW TO BUY A STOCK PHOTO

If you are a small business and want an image to use on your website or in a brochure then an easy mechanism to reach this end has been set up. See Stock Photos for Small Businesses.

Stock photographs are sold by by purchasing a right to use an image under terms set out in a license. The rights are set out in the license, a legally binding agreement between the buyer and the seller.

What licenses actually say varies - at this site you can only buy images that are rights managed. Rights managed stock photos are sold with a fee based on the buyer's specified use. The fee is calculated from several factors including size, placement, duration of use and geographic distribution. It also takes account of who is using it. It essentially prices photos according to their value to the buyer's business. A small business using an image in a display in store pays a vastly different amount to a big business wanting to run national advertising..

If you choose a traditional license then you will get much greater (but not complete) exclusivity as compared to a 'royalty free' photo and the photographer will be able to tell you if there is any previous use that might affect your own business's use of the image. (Under a royalty free license you may find that a competitor has used the same image or that many others have used an image in a way that may be embarrassing).

You are responsible that the use you put the image to is appropriate, in particular if the images contain pictures of recognisable people or trade marks or copyrighted designs. Some stock photos are model released for a large variety of uses as specified in the license agreement; others are not model released and use is far more restricted.
